The Decree-Law 20-A/2023 of 22 March, establishing the General Regime for the Application of the European Funds of Portugal 2030 and the Asylum, Migration and Integration Fund for the 2021-2027 programming period was published.
After the publication of the governance model of European funds, established in the Decree-Law No 5/ 2023 of 25 January, this regulation defines the general regime for the application of Portugal 2030 and relevant funds, namely regarding applicable rules, eligibility requirements, beneficiaries’ obligations and funding models and forms, according to the Regulations (EU) No 2021/1056, 2021/1057, 2021/1058, and 2021/1060 of the European Parliament and the Council, of 24 June 2021 and Regulations (EU) No 2021/1139 and 2021/1147 of the European Parliament and of the Council of 7July 2021.
In accordance with European legislation, general rules on procedures for the analysis, selection and decision-making of operations were defined, imposing on all entities involved in the implementation of European funds, respect for the Charter of Fundamental Rights of the European Union, the United Nations Convention on the Rights of Persons with Disabilities and the duty to contribute to sustainable development and to preserve, protect and improve the quality of the environment, taking into account the “polluter-pays principle” and the “not to cause significant harm principle”.
The diploma applies to operations funded by the ERDF – European Regional Development Fund, the ESF+ – European Social Fund Plus, the CF – Cohesion Fund, the EMFF – European Maritime Affairs, Fisheries and Aquaculture Fund, and by the FTJ – Fund for a Fair Transition, also applying (with the necessary adaptations) to the AMIF – Asylum, Migration and Integration Fund.
